Terms & Conditions

These Terms & Conditions apply to all quotations, instructions, and works undertaken by CJM Roofing & Plastics (“we”, “us”, “our”).

By accepting a quotation, making payment (including deposits), or issuing instruction verbally, in writing, by text, email, or via any third party, the Client (“you”) agrees to be legally bound by these Terms.


1. Acceptance of Terms & Instruction


1.1 Acceptance of a quotation, payment of deposit, or instruction to proceed constitutes full acceptance of these Terms & Conditions.

1.2 No works will be deemed formally accepted or scheduled until:

  • a deposit has been received and cleared in full, and
  • written confirmation of instruction has been issued by CJM Roofing & Plastics

1.3 No verbal instruction or informal communication shall override written confirmation.


2. Scope of Works


2.1 Works are strictly limited to those described in the quotation.

2.2 Any additional works required due to site conditions, unforeseen issues, or Client instruction will be chargeable.


3. Payment Terms


3.1 A minimum 40% non-refundable deposit is required to secure all works.

3.2 No works will be scheduled or guaranteed until the deposit is received.

3.3 The remaining balance is due within 48 hours of completion of works, unless otherwise agreed in writing.

3.4 Late payment may result in:

  • suspension of works
  • withholding of certificates or documentation
  • debt recovery action

3.5 Non-Refundable Deposits


All deposits are strictly non-refundable under any circumstances.

This includes cancellation, delay, change of mind, access issues, or third-party delays.

“By paying a deposit, the Client acknowledges and agrees that the deposit represents a reservation fee and is not subject to refund under any circumstances.”


3.6 Late Payment & Interest


Interest will be charged under the Late Payment of Commercial Debts (Interest) Act 1998 at:

  • 8% above Bank of England base rate
  • plus statutory recovery charges

3.7 Payment Enforcement


Failure to pay any invoice may result in immediate suspension of all ongoing or future works.


3.8 Materials Ownership


All materials remain the property of CJM Roofing & Plastics until full payment is received.


4. Third-Party Contractors & Liability Exclusion


4.1 The Client may engage or request additional contractors (including other trades or specialists).

4.2 CJM Roofing & Plastics is responsible only for its own roofing works.


4.3 No Liability for Third Parties


We accept no liability for:

  • injury or death involving third-party contractors
  • negligence or breaches of health & safety by third parties
  • failure to provide RAMS, insurance, or compliance documents
  • workmanship, delays, or actions of third-party contractors
  • any non-CJM personnel on site

4.4 No Duty to Supervise or Assess


We are not responsible for:

  • checking RAMS or risk assessments
  • verifying insurance or competence
  • supervising third-party contractors
  • coordinating other trades

4.5 Client Indemnity


The Client agrees to fully indemnify CJM Roofing & Plastics against all claims, losses, damages, or legal proceedings arising from:

  • third-party contractors
  • site coordination failures
  • unsafe site conditions not caused by us

5. CDM 2015 & Principal Contractor Exclusion


5.1 Standard Position


We are not appointed as Principal Contractor under CDM 2015 unless expressly agreed in writing.


5.2 Client Responsibility


The Client is responsible for:

  • CDM compliance
  • coordination of all contractors
  • overall site safety and welfare

5.3 Multi-Contractor Projects


Where more than one contractor is involved:

  • the Client may be required to sign a CDM 2015 & Principal Contractor Exclusion Confirmation Form
  • no works will commence until this is completed
  • failure may result in delay or cancellation

5.4 Principal Contractor Appointment


We will only act as Principal Contractor where:

  • agreed in writing
  • a separate contract is signed
  • additional fees are agreed

6. Instruction of Works


Instruction may be given via deposit payment, written acceptance, or confirmed communication.

No verbal instruction overrides written agreement.


7. Delays & Extension of Time


7.1 Works may be delayed due to:

  • weather conditions
  • access issues
  • safety concerns
  • third-party delays
  • emergencies

7.2 All completion dates are estimates only and not contractual guarantees.

7.3 No liability is accepted for delays outside our control.


8. Site Control, Authority & Site Management


8.1 CJM Roofing & Plastics does not act as site manager, Principal Contractor, or overall site controller unless expressly agreed in writing under a separate formal contract.

8.2 The Client retains full responsibility for:

  • site control and coordination
  • managing all contractors on site
  • ensuring compliance with CDM 2015 and all applicable legislation

8.3 The Client is responsible for ensuring all contractors are competent, insured, and operating safely and legally.


8.4 Right to Stop or Suspend Works


We reserve the absolute right to stop, suspend, or withdraw from works immediately (without liability) if, in our reasonable opinion:

  • the site is unsafe
  • coordination between contractors is inadequate
  • legal compliance is not being met
  • unsafe systems of work are identified
  • access or working conditions are unsuitable

8.5 No liability shall be accepted for delays, costs, or disruption arising from suspension under this clause.


8.6 No Site Management Responsibility


Nothing in this agreement transfers responsibility for:

  • site-wide supervision
  • contractor coordination
  • health & safety management of other trades
  • legal compliance of third parties

9. Site Conditions & Client Responsibility


The Client must ensure:

  • safe access
  • accurate information
  • hazard-free conditions
  • removal of valuables or fragile items

We accept no liability for inaccurate Client information.


10. Liability Limitation


We are not liable for:

  • indirect or consequential losses
  • third-party delays or failures
  • pre-existing structural defects
  • incorrect Client information

Liability is limited to contract value only.


11. No Oral Agreement Clause


No verbal agreement or instruction shall override this contract or written quotation.


12. Complaints


Issues must be reported within 7 days of completion.

We will assess and rectify genuine defects where appropriate.


13. Cancellation


Deposits are strictly non-refundable under all circumstances.

Cancellation may result in charges for materials, labour allocation, and lost scheduling time.


14. General


14.1 These Terms are governed by the laws of England & Wales.

14.2 If any clause is unenforceable, the remainder remains valid.

14.3 These Terms may be updated at any time.
